Key provisions of the EU Packaging and Packaging Waste Regulation now apply
As of 12 August 2026, most provisions of the EU Packaging and Packaging Waste Regulation apply across the European Union. The Regulation introduces common requirements for packaging sustainability, labelling, chemical composition and reuse, as well as new obligations for manufacturers, importers, distributors and other economic operators.
Although the Regulation entered into force on 11 February 2025, most of its provisions apply from 12 August 2026. As an EU regulation, it applies directly in all Member States.
From this date, packaging placed on the EU market must comply with the applicable requirements. Packaging that was already placed on the market before the relevant requirements began to apply does not need to be withdrawn or adapted solely to meet requirements introduced at a later stage.
New requirements for packaging and businesses
One of the key changes concerns substances of concern in packaging. The Regulation limits the presence of per- and polyfluoroalkyl substances (PFAS) in food-contact packaging. Packaging exceeding the limits set out in Article 5 may not be placed on the market, and manufacturers must hold technical documentation demonstrating compliance.
Manufacturers must also carry out conformity assessments, prepare technical documentation and issue an EU declaration of conformity before placing packaging on the market. Importers and distributors must verify that the relevant requirements have been met and must not place non-compliant packaging on the market.
Suppliers of packaging and packaging materials are required to provide manufacturers with the information and documentation needed to demonstrate compliance with the Regulation.
Reuse and refill
The Regulation also introduces additional obligations for reusable packaging. Economic operators using reusable packaging must participate in reuse systems and ensure that packaging is properly reconditioned before being used again.
Where consumers are offered refill options, businesses must provide clear information on refill rules and ensure that refill stations meet the applicable requirements.
Not all provisions apply from 12 August 2026. Some requirements will take effect later and are subject to transitional periods. Businesses are therefore encouraged to assess which obligations already apply to their activities and prepare for the next stages of implementation.
